Not sure if trolling but really? A punch in the head is substantially more risky than a minor zap from something that is designed to be safe and effective. There will always be outliers with ANYTHING. People that have underlying problems probably won't fair as well if tased but consider the likelihood of injury when it comes to a punch. It doesn't matter who you are or what your underlying issues are, a punch to the head is much more likely to cause damage in some way or another. The brain isn't designed to withstand shockwaves from a strike to the jaw (hense why people pass the fuck out when punched hard enough in that location).

For what it's worth, this guy was not incorrect, really much at all. He was obviously thinking of the Democratic Republican party; which was the party of Jefferson, Madison, Monroe, and John Quincy Adams.
It was typically shortened to "Republican Party" and really doesn't have much connection to the the republican party of Lincoln. The original Republican party split, giving rise to the Democratic party of Andrew Jackson.
But this kid was clearly thinking of the original Republican Party, called the "democratic republican party" and whose first presidential candidate was Jefferson.
He still looked like a douche, but not because he was necessarily wrong.

The thing is, the Democratic Republican party had nothing to do with Republicans, and is now proceeded by the Democratic party.
The Republican Party did not stem from the Democratic Republican party whereas the Democratic party did. So there is no relation between them.
Doesnt_Draw_Anything ยท 17 points ยท Posted at 23:24:09 on August 25, 2014 ยท (Permalink)
I would say he is wrong. There is the party with Lincoln, called the Republican party, and the Democratic Republican party, that was also called the Republican Party. Just like you said.
When the guy asked the question, and the kid asked for clarification, the guy gave clarifcation, by saying The Republican party, if he meant the Jefferson Republicans or the Democratic Republicans, he would have said so.
Then the kids gets it wrong further when he says Democratic Republicans after the guys gives the answer of Lincoln. Which is 100% wrong.
lazespud2 ยท -4 points ยท Posted at 04:28:10 on August 26, 2014 ยท (Permalink)
you make a very good point when you bring up him asking for clarification. Though the host clearly had no idea of the previous republican party... but the fact that the host clearly didn't seem to know should have been enough to tell the douche that he was being way too clever by half.

Nevertheless, it was the "Democratic-Republican" party. The question was a fair one because the modern Republican party was born into presidency with Lincoln, although he was the second candidate for the party.

Yes but how is he different from people (e.g. obnoxious students who have unnecessary conversations with professors during lectures) who attempt to steer or rather simply digress from a topic just so they can drop a barely relevant tidbit they know of.
I never thought this kid was getting his facts wrong, people like that seldom are and they will argue to the ends of the earth if they are allowed or clarify because they're not "wrong". Too bad gameshows, like standardised tests, have particular contexts. So he's not wrong about his topic but the whole situation was irrelevant. That was the cringe--the tingling annoyance in your spine that makes you wonder "why is this happening?" and shiver.
CarlosFromPhilly ยท 1 points ยท Posted at 02:18:41 on August 26, 2014 ยท (Permalink)
He was wrong. The question asked what republican candidate was the first to be elected president. The Democratic Republican Party was no longer a party when Lincoln was elected; the Republican Party was.
He looked like a douche largely in part because he not only was wrong, but didn't know the answer anyway.
LosAngelesVikings ยท 1 points ยท Posted at 09:18:48 on August 26, 2014 ยท (Permalink)
Of course he was wrong. He was completely wrong. Even after being told that the answer was Lincoln, he still thinks he was a member of the Democratic-Republican party (aka Jefferson's party). That's just wrong.
lazespud2 ยท 1 points ยท Posted at 16:16:26 on August 26, 2014 ยท (Permalink)
I got the sense that he was still fixated on his "brilliance" about knowing about the original Republican party, and was just spitting it out one last time, kind of like Dustin Hoffman's Rain Man talking about "gotta see Wapner".
I suspect that maybe, what, 30% of Americans would know that Lincoln was the first president of the (modern) Republican party, and maybe what, less than 1% of Americans know of the predecessor Republican Party.
But I will bet that almost 100% of people that know of the previous Republicans know that Lincoln was the first president from the modern Republicans.
But I will grant you his behavior is so douchey that he may be that rare person that has obsessed over tiny obscure facts, without knowing basic stuff.
madarchivist ยท 1 points ยท Posted at 11:40:50 on August 26, 2014 ยท (Permalink)
How does it matter what he "was clearly thinking"? The only thing that matters is what the host actually asked and what he asked had nothing to do with the "democratic republican party", which means that the kid is dead-wrong.
lazespud2 ยท 1 points ยท Posted at 16:09:41 on August 26, 2014 ยท (Permalink)
I'm no expert in revolutionary-era politics, so I can only go by what the wikipedia said. From that article it seems pretty clear that there is little agreement on party names in those early years, but the noted members of this party called themselves "republicans" and members of the "Republican Party." And Thomas Jefferson, whom used those terms in his correspondence, was this party's first candidate to become elected president. If you asked Thomas Jefferson in 1820, "hey, were you the first republican elected president" you get the sense that he'd tell you "of course".
It seems to me that given that Thomas Jefferson referred to himself and his party as Republicans, and he was the first president elected from that party, then saying it's "dead-wrong" is a perhaps too strong.
HoldenH ยท 1 points ยท Posted at 20:51:15 on August 26, 2014 ยท (Permalink)
He was wrong though
lazespud2 ยท 1 points ยท Posted at 21:07:43 on August 26, 2014 ยท (Permalink)
I think you can argue either way. He was not wrong in this sense: he was clearly thinking of the original Republican Party, the party that Jefferson belonged to and which is also called by Historians "the Democratic Republican party" (but by Jefferson as "the republican party"). Jefferson was their first candidate elected president. He didn't get a chance to say Jefferson, but it's clear that is what he was thinking of. He was just thinking it was a kind of trick question which he knew the answer; but was just trying to get clarification that it WAS a trick question.
Here's another trick question for you: What state was Lincoln born in? Most people say Illinois, but of course they are wrong. Smarty pants says Kentucky, but they are wrong too. Lincoln was not born in a state. He was born in the Commonwealth of Kentucky.
Basically you have to be a mind reader of the questioners intent to determine whether or not you are going to get that Kentucky question right.
And besides all that; the kid never actually gave an answer. Meaning he was neither wrong nor right (unless by virtue of him asking for clarification then he was docked points).
[deleted] ยท 1 points ยท Posted at 02:08:56 on August 27, 2014 ยท (Permalink)
It seemed as though he was thinking of the Democratic Republican party because he did not know it was different from the modern republican party. It should have been very clear if he knew there was a difference after the host reiterated "Republican party" that the Lincoln party was the intended one.
Anachronym ยท -1 points ยท Posted at 18:31:28 on August 25, 2014 ยท (Permalink)
Actually, he was totally wrong.
If you read the description of the party in the link you've provided, you'll see the tenets of the Democratic-Republican party align with the tenets of the 19th century Democratic party and not the 19th century Republican party: "The party was strongest in the South and weakest in the Northeast. It favored states' rights, the principle of 1798, and the primacy of the yeoman farmers."
There was only one correct answer to the question: Abraham Lincoln. Abraham Lincoln was the first Republican candidate to become president of the United States. Period. The 19th century Republican party was ideologically preceded by the Whig Party, not the Democratic-Republican party.

Sorry to get into semantics, but I don't think "totally wrong" would qualify. I tried to be as clear as I could in my response, indicating, as you noted, that the roots of the Democratic party stem from the Republican-Demoncratic Party.
However, since you are basing your response on the wikipedia article; it would be important to note that it uses "Republican Party" as shorthand for the party throughout, as well as lines like "republican strength in congress". And it further notes:
And finally it notes:
So back to the video in question. The host asks
"Name the first Republican Candidate to become president of the United States"
Since Jefferson was the first "national nominee of the republican party", then I think you can certainly make a case that what the douche on the TV show was getting at was not incorrect, or at least not, as you suggest, "totally wrong".
I don't think anyone would disagree that the current Republican party was not related to the First Republican party (which essentially split into the Democratic party and smaller parties).
And I would be tempted to agree with you if there was an obscure party from 225 years ago named "the Republican Party" that no one remembers, and had no candidates of note. But the actual Republican Party that DID exist gave us four presidents, the first of which was Jefferson.
mcsharp ยท 1 points ยท Posted at 19:28:55 on August 25, 2014 ยท (Permalink)
It's not even semantics, you're spot on. Don't mind him.
mcsharp ยท -5 points ยท Posted at 19:27:23 on August 25, 2014 ยท (Permalink)
Ugh. Well the Republican party is in no way similar to the one of Abraham Lincoln. So your point is moot.
It's a simple question, not : "who was the first president of the republican party wherein that party most resembled the republican party of today given these three criteria - state's rights, general ideology and geographic popularity?"
Now you're as bad as that kid. And you should feel bad.
Anachronym ยท 4 points ยท Posted at 19:46:59 on August 25, 2014 ยท (Permalink)
The question was "who was the first Republican candidate to become president of the United States?" The answer is simple. Abraham Lincoln. Period. The answer has nothing to do with the Democratic-Republican party โ in fact, Lincoln, the Republican Party and the former Whig Party's views directly contradicted those of the Democratic-Republican party (which became the democratic party in the early 19th century).
The kid was trying to sound smart by dropping a reference to the Democratic Republican party, but he incorrectly believed that the DR party grew into the Republican party, which is simply incorrect. The DR party developed into the Democratic Party. The Whig party developed into the Republican party.
I quite honestly have no idea why you brought up the 20th century ideological switch that occurred in the 1940s-1950s. The fact that the Republican party of today is in no way similar to the one of Abraham Lincoln literally has no bearing on the question asked, which was about the 1860s, not the 20th century, and not today. The question was, as you correctly stated, quite simple and involves identifying the first republican candidate elected president: Abraham Lincoln. The 20th century is unrelated to the question.

There was a Democratic-Republican party, but it didn't last to Lincoln's time. Lincoln was the first president elected from the Republican party, which was very new at the time.

In case anyone is wondering just how wrong this kid is:
The Democratic-Republican party was founded in 1791 and dissolved in 1825.
The National Republican party was founded in 1825 and dissovled in 1833.
The Republican party was founded in 1854 and is the modern party we know today.
Sounds like he thought they were all the same thing.

The term Democratic-Republican Party, is the name used primarily by political scientists for the Republican Party or the Jeffersonian Republicans. It was the second political party in the United States, and was organized by Thomas Jefferson and James Madison in 1791-93, to oppose the Federalist Party run by Alexander Hamilton.
Technically, he's kinda right.
[deleted] ยท 93 points ยท Posted at 13:11:27 on August 25, 2014 ยท (Permalink)
No he's wrong. Because Lincoln was not a Democratic-Republican. Lincoln was a Republican-Republican. His party was cobbled together out of disenfranchised northern democrats and the defunct Whig Party. Jeffersonian Republicans were absorbed by the Whigs post 1832 elections. The Lincoln Republican Party had a good deal of Federalism in its core beliefs which would be the opposite of the Democratic-Republican Party which was anti federalism.
So the kid would have sounded smart if he wouldn't have had that snide "democratic-republican" on the back end. He was right, until he let out that "see I knew what I was talking about" under his breath whisper.

[deleted] ยท 8 points ยท Posted at 14:26:04 on August 25, 2014 ยท (Permalink)*
Correct, but by 1856 the Whig as a national party was all but dead. In 1860 all the Whigs that didn't leave for Lincoln's Republican Party reformed into the Constitution Party and pitted off from there. The early death of William Henry Harrison really crushed the party's major momentum they were building up in the 40s. They're a great metaphor for how quickly a strong national political party can have a president elected and all but disappear less than a decade later.
You see that several times throughout the 20th century. Though the party names don't change, the political platform that exists within them all but evaporates. This graphic shows a great timeline of parties flip flopping on each other every so often. https://www.historyshots.com/parties/Index.cfm

As hoosier pointed out, it would have looked like he was simply looking for clarity to the question asked and was refused a clarification. His snide comment at the end showed his ignorance though.
W/o clarification, Jefferson would have been equally correct. The kid obviously didn't know that though.

No. He is completely wrong. The question asked who the first Republican presidential candidate was. That would be Lincoln. The first Democratic-Republican candidate was Jefferson. The kid even asked for clarification and got it.
The two parties were very different and didn't even overlap in time. The Republicans simply took the name to tie in with Jefferson (good marketing on their part), but what their party stood for was actually more in line with Adam's Federalist Party, which was the counterpart to the Democratic-Republican Party.

They also think every citizen has a secret government account of 300,000 dollars or something, but they are big abusers of courts and paperwork. Basically they try to file frivolous leans against the property of government employees. It's complex to explain but they've gotten themselves on a lot of peoples radars.

Correct. Also the rights aren't granted by the government, the government doesn't have the power to grant or not grant these rights. We're born with these inalienable rights because we're human beings. The government simply recognizes them and can't infringe upon them.

The phrase does, but the idea is that speech, movement, etc. are natural rights and the "Bill of Rights" is meant to constrain the government from infringing them, not to grant them to the people.

That's because trespassing infringes on the victim's natural right to security of property, in the same way that murder infringes on the victim's natural right to live.
JurisDoctor ยท 1 points ยท Posted at 03:13:51 on August 26, 2014 ยท (Permalink)
Correct, because your rights are not absolute and they're subject to the competing interests of others such as the government, business entities and other people. The government can pass legislation restricting natural rights. These laws must pass a strict scrutiny test as set forth by the Supreme Court of the United States but it can be done. TL;DR Your rights are not absolute because you're not king of the fucking planet.

This is the exact same argument as 'Why won't you consent to a search? You must have something to hide.'
I hope I don't have to point out how falacious that is.

Lawyer here. I've dealt with a lot of these nutjobs (they surface a lot in the context of foreclosures). This guy doesn't think that what he's saying is inconsistent -- his position is that he is not a citizen, but rather a "free man on the land." Persons (even if not citizens) have inalienable rights that come with birth, freedom of movement being among them.
Their whole ideology is horse shit, of course, and I've never, EVER seen this nonsense work ever. But I know what they believe.

Kl3rik ยท 2 points ยท Posted at 01:50:37 on August 26, 2014 ยท (Permalink)
Yeah, I think it's from the misuse of the word so much that people just associate it with physical violence. Just like, according to the law, making unwanted advances of someone is sexual assault, raping them is sexual battery. Assault has been used incorrectly though for so long that people don't know the meaning. I generally don't correct people on it until they start bringing up battery and then I explain the difference.

In the definition of the law, battery can mean any kind of unwanted physical action on another person.
In this case though, it would have no holding in a court though.
dezmodium ยท 1 points ยท Posted at 14:01:10 on August 25, 2014 ยท (Permalink)
In my state battery also has an element of intent. The battery must have a reasonable assumption of intent to harm.
Like, holding your arm out to stop someone or gently pushing them away from you wouldn't be battery. But throwing a punch would or shoving someone into traffic.

It's worth some googling about over, but they basically believe in some magical voodoo version if the law where the federal government owns us like an investment tool and that tassled flags in courtrooms mean we're operating under maritime law and that... I don't know... using capital letters a lot in incomprehensible court filings citing the Commercial Code can get them out of any possible legal problems.
I honestly can't remember much specific, but I spent a pleasant afternoon a few years ago reading about them. The thing is, they aren't all fun and games. Sometimes they drive around with long guns and murder cops during traffic stops for impeding their freedom of movement or they lead cops on high speed chases while drunk and threatening a 911 dispatcher on their cellphone during the chase. As a movement I think they're actually scary, because you kind of have to be a bit off your rocker to believe a lot of the shit they believe.
Edit: Here is the recording of the drunk lady.
Here's a video talking about the incident where two cops are killed during a traffic stop.
And here's an extremely high quality website of the highest possible quality that takes you through 34 chapters of an e-book primer on how to be cool like all the sovereign citizen kids.

I was at a local university in 2003 when the Bixby's killed two officers for trying to mediate a dispute over expanding the highway. To this day you will occasionally see cardboard "license plates" in this area declaring someone to be a "Sovereign Citizen". I have to wonder what local policy is on dealing with these individuals since the 2003 shooting.
Danzo3366 ยท 1 points ยท Posted at 01:16:54 on August 26, 2014 ยท (Permalink)
I'm going to ask what made you think of a few these links of these people acting crazy are from this type of sovereign citizen people and not just typical crazy nut cases.
banjist ยท 2 points ยท Posted at 02:42:24 on August 26, 2014 ยท (Permalink)
I'm trying to parse what you wrote here. I do think that these videos are representative of a portion of the sovereign citizens movement, but I admit it is a diverse group. At the end of the day, whether an individual sovereign citizen is part of the white supremacist, christian dominionist or angry young hipster hyper-libertarian flavor, once the pseudo-legalese and pseudo-philosophical language they use is stripped away what's left is generally just people who don't want to follow the rules of society.
They feel that the state is corrupt and unjust (and I have a lot of sympathy for that idea), but then rather than involving themselves in civic society and working to change things they take the leap to say that they can continue to reside in the US (I think the movement is in Canada too if not elsewhere) but by saying some magic words they then don't have to abide by any laws they don't want to. A bit of civil disobedience is one thing. Filing frivolous liens and lawsuits against innocent individuals, shooting cops and otherwise creating violent confrontations with the state in the interest of your desire to not be beholden to the law, driving drunk without a license and then claiming the cops owe you $300,000 for the privilege of stopping glorious sovereign you and all the other shit you can easily find with some quick searches for sovereign citizens in the news is dangerous and crazy.
The young sovereign types like the guy in OPs video seem fairly benign, but if that guy really believes all this horseshit he will run afoul of the state over and over again and it will make his life difficult in a way he believes to be utterly unjust. Who knows how he'll turn out a few decades down the line. I really do think that just about anyone who subscribes to the beliefs of sovereign citizens in the sense of being a true believer, rather than just an opportunist thinking they found some way to get around paying taxes and car registration, is likely to be mentally unbalanced and a potential danger to public safety. Read their documentation and beliefs from the third link in my comment above. The shit's crazy.

They don't believe that the federal government is legitimate. Which makes their interpretation of the law very wonky.
It's basically an excuse for them to refuse to pay taxes.
Aint_got_no_agua ยท 2 points ยท Posted at 01:13:58 on August 26, 2014 ยท (Permalink)
Sovereign citizens are a big movement especially in Idaho, and basically they think the federal government is a corporation. They issue their own documents, driver's licenses, warrants, license plates, and passports and try to pass them off as real. They believe in some very strange things but they are very committed to it, and it basically boils down to "fucking with federal employees". They only legal authority they recognize is elected Sheriff's and their deputies.

He's kind of in the right here though. He never did use "force" and as far as you can tell in the video he didn't pose an immediate threat to anybody other than being a huge pain in the ass.
That being said, his political beliefs are bullshit. If we're allowed to just pick and choose which laws apply to us based on what our political philosophy is laws are meaningless. If you hate the laws so much, do something to change them instead of saying "laws don't real cause I don't like them"

I have a pair because I worked for a shop where they were sold. It was a SCUBA shop with a large indoor pool, so I was constantly getting my feet wet and having to walk around all day, so these shoes were perfect. Plus, since I wore them, I was able to sell them better. They're ugly as sin, but pretty comfortable, especially with the socks.
H_L_Mencken ยท 2 points ยท Posted at 16:29:58 on August 25, 2014 ยท (Permalink)
That's pretty much what I wore them for. I used to run an apple orchard, and when we made cider, the sanitizing process just before putting them in the machine was rapid and messy. Water would be everywhere.
They were also great for climbing the apple trees when picking, because you could use your toes for better grip on branches. I would never leave the orchard with them on though.
Korinu ยท 1 points ยท Posted at 22:31:30 on August 25, 2014 ยท (Permalink)
http://www.vibramfivefingers.com/index.htm they're really comfortable once you get use to them. My wife and I wear them as our regular shoes in the summer time. It's nice not wearing socks too lol. They are pretty expensive though and they don't last to terribly long. I've only ever bought new pairs when they go on sale.
Laureltess ยท 1 points ยท Posted at 03:32:58 on August 26, 2014 ยท (Permalink)
They're super comfortable, but I feel like such an absolute walnut wearing them in public...I only wear them running or hiking away from people.
cmallard2011 ยท 1 points ยท Posted at 14:55:39 on August 25, 2014 ยท (Permalink)
Just make sure you don't run in them (their intended purpose) http://www.runnersworld.com/general-interest/vibram-agrees-to-settle-class-action-lawsuit
ArchersTest910 ยท 2 points ยท Posted at 16:07:57 on August 25, 2014 ยท (Permalink)
I've never worn them but I'm pretty sure they aren't harmful, they just don't provide any real benefit(as was claimed in advertising material, hence the lawsuit). They're just a shoe, not a health hazard.
cmallard2011 ยท 1 points ยท Posted at 16:21:00 on August 25, 2014 ยท (Permalink)
I think they are a health hazard: http://www.runnersworld.com/barefoot-running-minimalism/study-vibram-fivefingers-lead-to-greater-risk-of-foot-bone-injury
ArchersTest910 ยท 1 points ยท Posted at 16:29:14 on August 25, 2014 ยท (Permalink)
Interesting. I wonder how that compares to barefoot running.
cmallard2011 ยท 1 points ยท Posted at 16:36:59 on August 25, 2014 ยท (Permalink)
I think if you have a strong running background then running barefoot on springy grass or the beach once a week can be ok. People who wore the Vibrams definitely had a placebo affect that made them more confident they wouldn't be injured. If you're smart I think it can be done right. I am not a doctor though so I could completely wrong.

"The trial court administrator says typically a taser is used when verbal dialogue fails to bring a person into compliance"
Textbook example of when to use a taser then.
stealthmodeactive ยท -13 points ยท Posted at 19:06:41 on August 25, 2014 ยท (Permalink)
I don't agree with how quickly they used the taser though. The guy could have at least given him a warning like "Sir, if you do not stop right now I will tase you."
xodus989 ยท 10 points ยท Posted at 19:37:11 on August 25, 2014 ยท (Permalink)
He begin escelating. He could have walked away. At the point where he tased him, he very well may have attempted to move forward again. Going hand to hand to detain with a non-compliant subject is no longer first line of defense, tazing is at is is much safer for the officer than going hand to hand. No reason to put the officer in danger because of a non-compliant subject.
Accipiter ยท 5 points ยท Posted at 21:06:48 on August 25, 2014 ยท (Permalink)
Raising your weapon is a warning that you're prepared to use it. The guy already tried pushing past them once, and kept blathering about his rights and whatnot.
It was definitely a low-power unit too, since he recovered from the shot very quickly - enough to start bitching at them some more.
stealthmodeactive ยท -5 points ยท Posted at 21:42:28 on August 25, 2014 ยท (Permalink)
You make it sound like he raised it for an extended period of time. The rate he took it from his belt and shot him there was barely any time for the guy to back off once he realized he had a taser pointed at him.
I don't agree with what the stupid guy with the camera did, but I don't agree with how the guy just decided he's gonna shoot this guy with a taser with no warning. It's not like he said "try that again, I'll tase you"
Accipiter ยท 5 points ยท Posted at 21:55:15 on August 25, 2014 ยท (Permalink)*
It was non-lethal force used against someone who had been an obstructionist asshole since first setting foot in the building. If you watch the other videos, he was causing grief and problems for everyone the second he walked into the courthouse - including against the guy that ended up tazing him.
Like I said, it was a low-power weapon used in circumstances where someone is disrupting normal operations and refusing to cooperate with instructions. This guy refused to cooperate with the entire staff - repeatedly - and continued to escalate and be a jackass (especially with the whole "I don't have a first or a last name and I'm not a person" crap), to the point of attempting to physically push past the guys into the courtroom. As soon as the clown with the camera got physical, that's when the tazer came out. The guy straight up said "step back" and instead, camera-douche STARTED to say "...and you're using" which likely would have continued some horseshit like "unnecessary force" meaning he was very much aware that a tazer had been pulled. He didn't step back, so he got zapped.

I got you bro, but it's an article, here. Highlights include: $150 fine he has six months to pay because he's unemployed. Also he received180 days in jail, he served 26 before sentencing, the rest were suspended, and was originally carrying a pistol when pulled over for the bike infraction.
femaleontheinternet ยท 30 points ยท Posted at 14:38:29 on August 25, 2014 ยท (Permalink)

jimmy_three_shoes ยท 2 points ยท Posted at 17:42:43 on August 25, 2014 ยท (Permalink)
It's to pay for the hassle of having to convict you, because you did something stupid. $150 isn't a large or an exorbitant amount of money.
nimis_ebrietas ยท 3 points ยท Posted at 15:09:22 on August 25, 2014 ยท (Permalink)

Some courts will allow you to do community service if you're unable to pay a fine, a rate of $10 per hour of service is common.
[deleted] ยท 1 points ยท Posted at 17:01:38 on August 25, 2014 ยท (Permalink)

While I totally agree that this dude is an idiot and I'm grinning ear to ear that he got tased, I also agree that a step in the escalation of force was skipped (they could have just grabbed him and placed him under arrest, i.e. they tried verbal tactics, next is open hand not non-lethal weapons).
Whacked_Bear ยท 35 points ยท Posted at 13:39:16 on August 25, 2014 ยท (Permalink)
As I've understood he was just following protocol. "Typically a taser is used when verbal dialog fails to bring a person into compliance." This is to protect the bailiffs and people standing nearby.
Source
underdog_rox ยท 13 points ยท Posted at 14:43:07 on August 25, 2014 ยท (Permalink)
I believe you're right. The taser is a viable alternative to "man-handling" the guy, as in some situations where the officer (say a small female) wouldn't be able to otherwise. Also, closing the distance like that can potentially put the officer in harms way. A taser widens that gap. Also, there were citizens and judges and prosecutors everywhere. I'm kind of okay with officers being a little jumpy in a courthouse, as opposed to on our streets in our neighborhoods.
[deleted] ยท 2 points ยท Posted at 15:59:24 on August 25, 2014 ยท (Permalink)
Like others have suggested, the taser is not an escalation over physically grabbing and wrestling with somebody, it's a replacement. The taser does not put the operator in significant danger and immediately incapacitates the opponent, whereas a hand to hand fight might get both parties hurt.
I realize, though, that there are situations where tasers do and have killed people, but I suppose I'd rather be tased than I would be put in a chokehold and punched in the dick by some bored security guard.
Sparling ยท 0 points ยท Posted at 18:58:00 on August 25, 2014 ยท (Permalink)
This is where I disagree. The fact that tasers have killed people make it escalation over bare hand. "Chokehold and punched in the dick" is not what I'm suggesting and in fact I don't think that should ever happen (if you need to go that far taser is perfectly acceptable in the escalation of force... the suspect is using open hand so non-lethal is ok). I'm talking about 2 sizable, presumably trained bailiffs grabbing him and handcuffing. This dumbass wasn't being violent, just an asshole.
Apparently that's not the popular opinion, but I'm not convinced.
OneOfDozens ยท 0 points ยท Posted at 16:38:10 on August 25, 2014 ยท (Permalink)
my problem is with the fact he was then charged with battery. he didn't attack anyone or use force, he literally just tried walking by and was stopped.
The fact people made fun of him for yelling about battery is the most ironic part. He's mocked (rightfully) yet our government does it every single day and it's perfectly acceptable

What do you feel makes them so scary? It seems that the majority of their crimes center around tax evasion. Thought that is what they got Al Capone with, it just seems the government doesn't like them because they with hold their taxes from the government. Is there anything else that I am missing? I suppose it could be scary in the sense that they may be willing to do anything, as they don't believe that the law applies to them. But how can the be considered more of a threat than the terrorist we are fighting in the middle east that have already launched successful large scale attacks against the US and drew us into the last 13 years of war.
cynognathus ยท 6 points ยท Posted at 19:21:23 on August 25, 2014 ยท (Permalink)
Tax evasion is one of the easiest things the government can go after them for, making it the most prevalent.
I suppose I should have added all adherents to the Patriot Movement, which includes sovereigns, to my statement. These are the people who are inspired by Ruby Ridge, Waco, the Atlanta Olympics bombing and other events to fight against perceived government overreach. Timothy McVeigh and Terry Nichols were Patriots.
Being inspired to fight in support of those events scares me.
Because it is a domestic movement and more likely to affect LEOs and the general American public than terrorists in the Middle East. What is your definition of large scale? In my view, over the last 25 years, jihadist terrorists have carried out one large scale attack on US, 9/11. You could count the 1993 WTC bombing, as it injured 1,000 people.
Patriots and sovereigns carry out many more, smaller scale attacks. That is what is terrifying; not mass death, but repeated, smaller attacks on civilians and officers of the law from groups of people devoted to their cause and refusing to acknowledge any authority other than that which they construct.
gsav55 ยท 2 points ยท Posted at 19:56:14 on August 25, 2014 ยท (Permalink)
Thanks for breaking that down and explaining it to me. It almost seems like those who advocate standing up for your right, such as by not giving your ID at DUI checkpoints and Border Patrol instate checkpoints could almost be considered (patriots?? is that what you call members of that movement??) But it seems that the followers of the Patriot Movement are distinct in that they advocate using violence for their rights as oppose to 'civil disobedience'.
cynognathus ยท 5 points ยท Posted at 20:08:38 on August 25, 2014 ยท (Permalink)

Err, what makes them one of the scariest terrorist groups?
Half of the incidents on the Wikipedia page don't even have a direct tie to the beliefs of the movement.
It's simply, "John Doe shot two people. He was a member of the movement". Fine and dandy, but what does that have to do with anything? He was a member of AARP too, so that means they must be bad people?
bran808 ยท 2 points ยท Posted at 18:51:23 on August 25, 2014 ยท (Permalink)

The rights in the constitution are not granted to us, they are our rights. A few of our rights were spelled out to the government, as a restriction on them. The rights of the people can only be infringed upon, not granted. The bill of rights is a list of the rights which may never be infringed upon, most other rights may be infringed upon in certain circumstances for the greater good of society.
In the USA, freedom of speech/religion/etc. are considered inalienable rights of all people, citizen or not. The US works differently than most countries. The guy in this video is still an idiot though.

So, if he was born in the US but not a citizen where do we deport him to? Mom's house?

The Bill of Rights doesn't grant rights. It limits the power of the government.

That said, this guy is an idiot.

In America we have these... People... Who call themselves "sovereign citizens".
They assert that US federal laws do not apply to them for whatever psychotic reasons.
That's what you're seeing here.
Also toe shoes. You're also seeing toe shoes.
[deleted] ยท 9 points ยท Posted at 13:20:49 on August 25, 2014 ยท (Permalink)
They've actually got their own FBI watch list staff devoted to them. They're getting Ted Kaczynski crazy. Most are harmless idiots like this guy, but some are anarchists looking to cause problems.
Etherius ยท 16 points ยท Posted at 13:23:28 on August 25, 2014 ยท (Permalink)
Pretty much this.
At their BEST, they're armchair attorneys who think their interpretation of the law (irrespective of relevant case law) supercedes the US Supreme Court.
At their worst, they do not recognize the US federal government and see themselves as freedom fighters and liberators.
TitoTheMidget ยท 7 points ยท Posted at 15:27:18 on August 25, 2014 ยท (Permalink)
I find that most of the time they're people desperately trying to get out of a ticket and stumbling on some batshit sovereign citizen webpage, so they adopt it until the realize that it's not true at all.

I can't recall exactly but the Judge had asked him to stop filming or something and he eventually got ejected from the court room. You can see when the woman leaves holding up the papers that everyone in there is aware he was filming.
I think there was another video too. Not the news feed one somebody posted but more of his encounters with these guards.
EDIT Somebody else posted one of the videos of him entering the court and giving them shit at the metal detectors.

Courts generally have local rules about recording devices in the courtroom. The rule would be very specific to Idaho and to that county. Generally speaking, if cameras are allowed it's only for those with permission ie press which he is not despite . Just because the proceedings are open to the general public, a person isn't entitled to do whatever they want as if it were truly a public space.
[deleted] ยท 7 points ยท Posted at 19:54:47 on August 25, 2014 ยท (Permalink)

There are lots of irrational explanations for why they believe as they do, but in essence these 'Freemen' are convinced that laws don't apply to them unless they have made a prior agreement with the state that they will be bound by those laws.
Most of the rest of it is all half-baked explanations for how the state has tricked everyone else into making those prior agreements and how they are just too durned smart to be tricked themselves.

Quick point: don't watch youtube or reddit videos and believe you learned anything from them that you should apply if ever in front of a cop or judge.
Also: you don't "know" the law. You know the basis of many laws. You may know your "rights". Law is ever evolving and changing, is based on changing legislation and influenced by precedence of the practice and application of legislation to specific cases and circumstances.
If you're not someone who is researching or practicing the law on a regular basis, you don't know the law, and you should and will get tased like this douce in the video.

If you don't want to obey the government's laws, I guess you don't need the police, fire department, government funded research, and government subsidies of food. There's multitudes of other things the government does besides that too.

Obviously no one here is a Lawyer or works anywhere near a court. He does not have the right to film people in court. Why? Because the people in the court have a right not to be filmed if they do not want to. So if he was to film them he would be takings away a large group of people's rights by doing so. Ever seen sketch drawings of court hearings? That's because even the press can't do so in certain settings. That is why he is stupid. And everyone complaining about rights n shit.
TheLadyEve ยท 2 points ยท Posted at 21:12:42 on August 26, 2014 ยท (Permalink)
I remember seeing this before, and it's even more painful now.
Oh god, "one of the several..."
"Leave the camera with your mother..." Ouch. Freedom of the press? Is this person with the press?
What is this guy trying to prove? He reads some shit about his rights on the Internet, takes a camera in to "document abuse of power" and then gets told. These people are trying to do their jobs, and he's trying to instigate a conflict in order to prove that the government is the big bad wolf. There are a lot of things wrong with the government--starting at a courthouse and instigating arguments is not the way to make progressive changes.

I love the way how he simply cant respect authority, the officer clearly was slow about shooting him with the taser, and told him to step back, yet the camera guy didn't. yet, after the epic payoff he says "you're overstepping your boundaries". This man is a hypocrite. Almost shit myself laughing when he got tased.

You know when people applaud when a noisy family is forced to leave a restaurant? I really wanted to here that applause just when the taser hit.

So I just started law school a few weeks ago and this video is like the "Am I learning anything?" measuring stick.
I watch it every few days and if I can find something else wrong I've learned something! So far, in general terms, those words don't mean what he thinks they mean...especially joinder and citizen.
dakunism ยท 2 points ยท Posted at 03:33:54 on September 4, 2014 ยท (Permalink)
Very interesting! Obviously other than the "freedom of movement" shit, what else was he saying that he thought he was protected from?
TheManInsideMe ยท 3 points ยท Posted at 23:27:08 on September 10, 2014 ยท (Permalink)
You can't pick and choose which rules apply to you. You're a person and a citizen in the eyes of the Court, you dingus.
Joinder is typically an agreement between parties, showing some dude your ID isn't joinder.
You have freedom of movement insofar as you don't do anything that interferes with the rights of another's property or something that is outlawed, like entering a courtroom with a camera.
Surprisingly, he gets 'batter' right. Although since he was battered by an agent of the court in an attempt to prevent an unlawful action, FLAWLESS VICTORY P. BARNES.

I'm not saying that guy wasn't a douchebag; but what exactly was the reason that they tased him? I didn't really see him doing anything wrong enough to merit being tased...
junkeee999 ยท 3 points ยท Posted at 01:38:09 on August 26, 2014 ยท (Permalink)
Because he was trying to force himself inside a courtroom. That's pretty serious stuff. A courtroom is a pretty special place and it's no place to fuck around.
insufficient_funds ยท 0 points ยท Posted at 01:43:44 on August 26, 2014 ยท (Permalink)
I understand that. But there was really almost zero time between his last advance, the guy giving a warning with the taser out and then tasing him. I need to watch it again but it seemed to me like he was at least taking a step back right before being tased. Maybe not though...

He was given repeated declarations that he was not getting in with the camera. Then he chose to ignore that and try to push himself into the courtroom anyways. He was given several warnings to step back, and didn't.
You can't exactly reason with this guy's level of stupidity, so the tazer was justified IMO.

MrDoctorSmartyPants ยท 8 points ยท Posted at 22:45:51 on August 25, 2014 ยท (Permalink)
Wrong. The judge has the power to allow or disallow phones, cameras, press etc in the court room. In this case the judge decided to allow no such thing.
[deleted] ยท -7 points ยท Posted at 22:53:27 on August 25, 2014 ยท (Permalink)
This is incorrect. A judge can only remove spectators/press if they are a distraction.

More misinformation being spread.
A judge is in charge of proceedings, rulings, and maintaining order within the courtroom.
A public courthouse is owned an run by the PUBLIC. Whether that be through hiring of judges, bailiffs, and government staff.
Not one person is in charge of dictating rules of phones, cameras, or any electronic devices unless it disrupts the procedures of the courtroom.
Ignorance of common law is no excuse for belittling me.

Tylzen ยท 7 points ยท Posted at 01:20:48 on August 26, 2014 ยท (Permalink)
You're denser than lead.
Courtroom can have specific rules set by the judge.
Courtroom is a location within a courthouse.
Just like we have specific rules for bathrooms, divided by gender, even if there are other rules for other parts of the same building.
It is possible to divide a location into sub-locations, with different sets of rules.
[deleted] ยท -6 points ยท Posted at 01:21:54 on August 26, 2014 ยท (Permalink)
True, but all are under public rule due to the fact that it is on public property.

[deleted] ยท -2 points ยท Posted at 02:18:00 on August 26, 2014 ยท (Permalink)
A local judge is not the same as the President of the United States. Most of the furniture in the white house is privately owned.
The white house is also a historic building and is protected by certain special regulations considering the significant personnel.
Accipiter ยท 2 points ยท Posted at 02:54:42 on August 26, 2014 ยท (Permalink)
Ah, so what you're saying is that certain specific places can have special regulations and protections created and enforced by government officials, despite those places being publicly owned.

edit: Essentially, you're comparing a judge to the president. If you're going to draw such conclusions, I'm going to assume you're trolling and/or don't want to have a discussion.
Tylzen ยท 1 points ยท Posted at 01:26:19 on August 26, 2014 ยท (Permalink)
No, you can also have bathrooms on public property, but they are also under other rules. Same goes with courtrooms.
That is US specific, so it really depends on the judge that rules over the specific courtroom inside the courthouse. (since some courthouses may have more than one courtroom too)
I don't get what part you fail to grasp? That fact that the courtroom can have separate rules from the courthouse, or what?
MrDoctorSmartyPants ยท 1 points ยท Posted at 23:14:14 on August 25, 2014 ยท (Permalink)
