No but if whatever agency is in charge of endangered species labeled a large chunk of the land in Washington as protected then the industry would die and many towns with it.

In my area there isn't much hunting anymore since a local timber industry instituted fees to access the land they own which sucks because the contract they signed when they purchased the land says that they must keep it open to public use but the government official in charge of enforcing the contract is a retiree of said timber company. Surrounded by forest and we cant hike, camp, hunt or anything else without paying $600 bucks a year.

If I physically buy a CD and play it in my restaurant it's okay since the production fees (the backbone of these laws) are already paid.

I think it's really a feel thing. Even to a non-musician, clapping along to a song on the 2 and 4 when it actually accents the 1 and 3 just feels unnatural. Our ears can really tell us a lot of information without needing knowledge on rhythms.

Sometimes these are very specific wordings of a law's potential outcome. For example, the common "no hunting whales" example could be an extension of a law limiting the hunting of large mammals or local endangered species laws. I mean, under Federal law, it should be illegal to hunt whales in any state due to their endangered status, but then it isn't so silly-sounding.

Similarly, the common "no chaining giraffes to parking meters" answer would stem from a law forbiding ANYTHING from being chained to a parking meter.

Adults whose existence is funded by their parents or legal guardians/the government can vote. There is no poll test that asks about 'activity in the world'. An adult who pays literally zero attention to politics or the world around him, who lives in his moms basement on welfare, can head off to the booth on election day and randomly pick the candidates whose name he finds funniest. And that's fine. We accept that's his right.

I wouldn't be opposed to that if a majority of people agreed, but I wouldn't push support for it, mostly because they're such a small portion of the population. It seems really shitty to tell someone that they can't represent themselves in their government, but when they're mentally unable to fully understand the breadth of their choices I think it's OK to revoke voting rights.

There has to be a cut off somewhere. I think at 16/17, kids start thinking more about the world around them, and after high school a lot of kids have to grow up really fast. I think this makes 18 a good age to start allowing people to vote.

I do agree that there should be a gradual increase of responsibilities and privileges to avoid mass confusion on how to be an adult by people suddenly hitting the age of majority. That said:

a) The ages should make sense, and similar things should become permissible at the same time. How does it make sense that a 16 or 17 year old is old enough to consent to having sex (and all the possible consequences that go with, like pregnancy or STDs) but not old enough to consent to a partner taking nude pictures of them? As the other guy said above, it seems arbitrary where the line is drawn.

b) If we are going to have a single age where you suddenly become an adult, it should mean you're an adult in every way. I think it's ridiculous an 18, 19, or 20 year old in America is considered old and mature enough to smoke, vote, get married, do porn, die for the country, sign contracts, etc. but not drink. If you become an adult at 18, you should fully be considered an adult at 18.

The logic of the law in the UK is that, while 16 is the age of consent, you're not an adult until you turn 18. Which, at the moment, is causing problems for people in the two years in between, since any pictures of that person in a state of undress or in a sexual contxt are technically child pornography - so anyone that creates them, possesses them, or distributes them could be prosecuted for offences related to indecent images of children and be put on the sex offenders' register (List 99). This can include the 16-year-old girl who took the picture and sent it to her boyfriend - the police try not to criminalise them for this if it was voluntarily done and would have been perfectly legal if they'd waited a bit, but the law doesn't really allow for shades of subtlety.

Difference is who is being punished. If someone willingly shares photos with someone they are having a lawful relationship with, is it protecting them to punish them for pornography because they shared nude pictures?

If some pervert is using illegal material, coercing, or trafficking, of course they should be punished, but punishing the victim, or person the law intends to protect, makes no sense in any circumstance.

I know this happens, and there is legal basis and precedent for it, but I think it's a little misguided is all.

Still valid in the UCMJ, I worked on a case a couple of years ago that involved a plea to sodomy. However, they're smart enough to use it as a plea deal (reduction from forcible sodomy I think) and not just straight up charge people with it. This was after Lawrence v. Texas.

Generally, no. There have been a few instances of allowing it, though, on bases near the border of canada/mexico, because of people going over the border to get drunk and causing drama as a result.

Generally, the rule is follow whatever the local laws are. So when I was 20, everyone was perfectly happy that I was stumbling across the quarterdeck drunk off my ass when we were in Lisbon. But back in Norfolk, still 20, I'd have been written up.

At least in the US armed forces, any minor in the military can not drink on or off base if they're in the US. If the minor is deployed overseas, the drinking age on base is at the discretion of the base Commander.

Source: went to Germany for a family trip and stayed on base. Was allowed beer off base but not on base.

The military follows local laws. So if you're stationed in America you're not going to be drinking at a bar or on base unless your dorm mate shares. However if you are stationed in most other countries or are visiting one you are okay to drink there. (Someone correct me if I'm wrong, I don't remember there being anything covering drinking in the UCMJ)

Searching findlaw.com for laws in NY with the keyword "fingers" turns up 2 results. New York Executive Law ยง 838; which has to do with identification of the deceased by fingerprints. And New York Executive Law ยง 160-ddd; which has to do with coverage to workers who have lost body parts including fingers.

This law is literally a "common sense" law. It's to be able to prosecute bartenders who will continuously serve drinks to customers who are very visibly intoxicated without care to their health or well-being, and therefore the well-being of those around them.

Any DA who brought a case before a judge for a bartender serving a guy over .09 would get laughed out of a courtroom and told to stop wasting their time. It's for extreme cases and allows for police and judicial discretion.

It's a legitimate thing here in Tennessee. Another (ex)bartender I know was prosecuted for over serving after a man got a dui after leaving his bar. I think he blew a .09something. Guy lost his abc license and wasn't allowed to serve for 5 years. But that was it.

Not even later laws. You can make the argument it was overridden by even the Constitution itself (Article VI, Section 3), let alone the bill of rights.. Courts have held these laws to be entirely unconstitutional on Establishment Clause grounds (Torcaso v. Watkins and Silverman v. Campbell) rather than explicitly stating that Article VI Section 3 incorporates to the states, so the Article VI question is largely academic.

Indeed it is, you can make the argument (and I imagine Courts would sympathise with the argument) that even without the establishment clause, Article VI makes it unconstitutional:

The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.

The only issue is whether Article VI incorporates, which is an issue the courts have failed to address, since the First Amendment does incorporate.

Unless he said "Unbuckle that seat belt", nope. He asked for change, that does not at all require one to unbuckle a seatbelt. Shit, he could have just said "No" and drove on. If you don't put up resistance to an officer's suggestion, it's not entrapment either--if he says, "Hey, want some drugs?" and you go and buy them without hesitation, tough shit. You weren't entrapped. Had he badgered you into buying drugs, cornered you, then you'd have an entrapment case.

None of this matters in the slightest. If, instead of a police officer, he was indeed homeless, then it's not entrapment. It's how a cop can arrest a hooker by pretending to be a John--doesn't matter. Furthermore, the officer did not entice him to commit a crime. Try Kentucky. Our county has been dry for 50 years. To finally go wet we had to get a petition of 1/4 of the number of votes cast last election, to call a mandatory election. And the laws spell out we get exactly 2 bars and 2 wet restaurants, no more, no less. Although every X years the number of available licenses changes, and the county decides which businesses are allowed to have each license.

There was an attempt from local churches to try and get all the licenses so they could sit on them and prevent anyone from using them, but it thankfully failed. Still, the amount of legal hoops we jumped through just to see that first beer sold were crazy.

Ironically enough the way the law is written, you can keep going smaller, even going district by district in the county (we have 12 or so), having elections in each and end up with a patchwork of wet and dry areas.

If you think about it, dry states populace are actually more at risk from accidents then wet areas. Dry states don't actually ban you from drinking, they just make you drive further for it. Because the place is very much in the heart of Appalachia, bootlegging is a very big issue. Bootleggers will sell a 12 pack of beer to a 7 year old just as easily as he would a 30 year old, as long as the 7 year old has the cash. They don't have a liquor license on the line, so they'll sell to anyone. The nearest "wet" area was the college town half an hour up the road, and that's a long, boring, and thirsty road home for many drivers.

Luckily in small towns it's easy to get political without a big budget. Ours in particular: $0. We set up a Facebook page, one of our members dropped $10 on a domain with the tagline "Fire the Bootleggers," and I built the site. The churches had signs and threats ("We will never shop at any business that has or signs a Wet petition") and we had social media. We almost won, if not for the fact that young people don't vote as often as they should--and a nice amount of bootlegger no votes didn't help, either.

As a very devout Christian, I understand that alcohol was very much a part of everyday life in the Bible. Water wasn't exactly something you could trust back then anyway, while a glass of wine was nice and bacteria-free. Verses that said essentially said "if someone is dying from injury in battle, give them alcohol to ease their pain," and so on. I wrote a nice article on our webpage about it which got a few hundred views (in a town of about 2000) but it still wasn't quite enough.

Luckily we were able to use the election itself as research. The data showed exactly what regions wanted it dry and which ones wanted it wet--so the second election was only city-wide, where it easily passed a few months after the failed county-wide one.

Until recently in Tennessee, liquor and wine could only be sold in liquor stores and nowhere else, but liquor stores couldn't sell beer. Want a fifth and a six pack? Gotta go to two different stores.

That has changed now and wine can be sold in grocery stores and beer can be sold in liquor stores. It goes into effect this July I think. One odd thing though, if a grocery store wants to sell wine but there is a liquor store within 1000 feet, they have to get permission from the liquor store. I'm not 100% sure that part of the law passed, but I know it was in the original draft.

Also, on all alcohol sales, clerks are required by law to ask for ID for every single sale, no matter how old the person is. I get why this is in place, but if you're selling a six pack to a guy that is obviously 50 or 60 years old, I thinks it's a little unnecessary. I don't think most places ask for every sale, but it is a law.

I am not familiar with that one, but I have seen other examples of people that are young made up to look like they are old. I'm not saying that the law necessarily a bad thing, I'm just saying that it seems unnecessary in some cases. For instance, when I worked at a convenience store years ago there was a guy that was 85 or 86 years old and came in almost every day and bought a beer. I don't think it was necessary for me to card him every single day that he came in, but by law I was required to. The way the law is written, it does not allow for known customers. The way it is written, it requires the clerk to card every single customer every single time they come in.

I know there are some places that have private policies. I worked at one place that stopped selling at 1:00 am during the week even though it's legal to sell until 3:00 am. Their reason was they just didn't want anyone to be able to come in at 3:01 and try to argue the clerk into selling them beer. The clerk could say "We haven't been selling beer for over 2 hours."

Ontario has some similarly weird liquor laws.

Beer can be bought at The Beer Store (that's a brand name of store, not a generic name). Beer can also be bought at the LCBO.

Hard liquor can only be bought at the LCBO.

The Wine Rack can only sell Wines, but you can also buy wine at the LCBO.

There were recent law changes that allow some grocery stores to sell beer, and maybe liquor? I haven't followed that too closely, so I don't know the extent of that change. (Some perceptive Ontarians might notice that you could buy wine in certain grocery stores before this, but that's because The Wine Rack opened a bunch of stores inside grocery stores...)

Oh and alcohol-free beer and wine are available in grocery stores.

Also also there is a minimum price that alcohol can be sold at.

I remember reading an AMA on here once where a guy said he went to prison for almost killing a guy with a golf club cause he found him in bed with his wife.

It was really cool to read. One of the things he mentioned was his lawyer got him like a plea deal of 3-5 years or something. His lawyer told him that if they went to court he probably would've gotten like 15 years.

The short barrel rifle (SBR) law is pretty dumb imo. You can have a pistol no problem. If you put a butt stock on that pistol it becomes a rifle. Issue is, a rifle has to have a 16 inch barrel or it is an SBR which requires a butt ton more paperwork just cuz. It's the same gun but now it needs more regulation due to a stock. You also can't put a vertical grip on a pistol either.

We have that law here (western New York) in all the towns during the winter months, it's like October 15th through April 1st you can't park on the street overnight because of snow removal. They will ticket you too and your car will get plowed in, which sucks when you wake up and have to shovel out your car from a wall of icy hard snow.

There was a story on the criminal podcast recently about a guy with a record was approached about a job that involved robbing a drug dealer. The guy wasnt sure he wanted to do it but he wanted to hear him out. They met to talk it over and the guy said they had to go right then instead of talk about it. When he got there, there was no drug dealer, it was a sting. He was basically arrested for going to a place to look at possibly doing a robbery. This guy is currently in prison for a crime that was created by law enforcement to get an arrest. I think he got a huge sentence for this crime that was never committed and he never even committed to doing it. Just wanted information to consider doing it. Yeah, robbing someone is wrong but talking about it and considering is not.

In South Carolina, it is illegal for a minor to use a pinball machine. It's a felony and carries up to 10 YEARS in prison. I'm an attorney, I checked -it's on the books.

Apparently it dates back to a time when pinball machines were used for gambling. Unfortunately the law does not specify this.

Most of these are not-enforced and don't affect anyone. I'll give you one that is strictly enforced and affects every consumer in the United States:

The Imported Vehicle Safety Compliance Act of 1988. It makes it essentially illegal for US citizens to bring a motor vehicle purchased in foreign countries (except for Canada for the most part) into the United States on a permanent basis, unless that vehicle is at least 25 years old (most vehicles are designed to last about 10 years).

Bought a car in Mexico? You better keep those damn Baja plates because there's no way you will ever be able to register it here. As a result of this and non-recognition of EU/UN standards, the US and Canada have the smallest selection of new car brands and models available for sale anywhere in the world. Sucks for the consumer.

I heard not long ago the feds were taking another look at that, to see about possibly moving marijuana to Schedule II.

For those that don't know, Schedule I is "no known medical use" and "high potential for abuse", while II is "known medical uses" but still "high potential for abuse."

Meanwhile, the benzodiazepines (Valium, Xanax, etc) are Schedule IV, "known medical uses" and "low potential for abuse."

Incidentally, MDMA is also Schedule I (as OP mentioned), which a lot of psychiatrists/therapists fought against hard back in the '80s. Studies lately have shown again that it has therapeutic uses, especially in cases of PTSD.

It's not like they are saying if you're homosexual you can't donate. They ask when your last HIV test was, if you're still sexually active etc etc. everyone's blood is tested for HIV, but it can take a long time to show up in your body.

Actually thats exactly what they are saying. They single out M2M sex as strictly banned. As in if youve ever had M2M sex you can never donate blood. Even lesbians can donate blood if they have no other risk factors. Im taking this directly from the American Red Cross website.

Lesbians arent even mentioned. So "anyone with an alternative sex life"(whatever that is supposed to imply) isnt subject to the ban; only gay men are. I mean we're specifically singled out under the HIV/AIDS section. Don't know what to tell you. Ive not been allowed to donate blood for 4 years. I'm not homosexual and every blood test has come back clean but I'm classified as high risk for having multiple sex partners and tattoos.

It may also be where I live which I've never understood because I'm honest and forthright about my past while I know drug addicts are donating

Wow, what a great idea. Go design a blood test that reliably detects HIV shortly after transmission. Because right now you can have it for months before you'll test positive.

If you go to the Red Cross with that and they still won't take gay blood, then you can have a case to cry discrimination.

EThen straight ppl should be subject to the ban as well. They can get hiv just as well as any gay person. Lesbians as well.

Also there are two different tests already that can detect hiv within 2-3 weeks. There is no reason for the life long gay ban other than out right discrimination. If nothing else segregate the m2m blood and test it separately. If any show up as having stds you can toss it but they wont even do that.

Like it or not, gay men are much more likely to have HIV. They test the blood, but a negative test isn't a guarantee of being clean, especially if you contracted it recently.

It's the same with people who get tattoos in states with lax regulation on tattoo parlors.

Smoking bans for bars. I mean come on, its a bar. Only adults are allowed in. Drinking and smoking go together. To ban smoking in bars is about as ridiculous as banning alcohol in bars.
