Warden does not kill me if I make a 3 block tower

As you can see the warden does not kill me if I make a 3 block tower unlike java where you need to make a 5 block tower also the warden detects me when I throw a snowball but it doesn't detects the place the snowball land but it only detects me even if i am sneaking
