Standing on Shulker for a few seconds kicks you for flying

I know this Bug has already been reported but was declared as fixed in an earlier version.
I logged into an 1.9 Server and built something with Shulkers. As i changed my gamemode to Adventure Mode, i was kicked after a few seconds when standing on a shulker for "Kicked for flying"
